HCS/HB 428 - This act creates the crime of eluding a law enforcement official. Law enforcement official as used in this act means anyone defined as a peace officer in Section 590.100, RSMo.

The penalty for the crime of eluding a law enforcement official is a Class D felony when the person eludes a law enforcement official by operating a motor vehicle in a way that poses a substantial risk of serious bodily injury or death to any other person. All other cases of eluding a law enforcement official are Class A misdemeanors.
